Appeals Process for Management Faculty
Effective Date July 1, 2017
In the event that a management faculty member believes that the (1) Contracts and Promotion Policy, (2) Workload Policy, (3) Evaluations, Reappointment, and Promotion Policy, or (4) Sabbatical Policy has been incorrectly or inconsistently implemented in a decision with respect to that faculty member, that faculty member may appeal that decision.
Before a faculty member may submit an appeal, the faculty member must first talk with the faculty member’s Dean (if the decision was made by the Dean) or the Provost (if the decision was made by the Provost) to discuss the decision.
An appeal must be presented in writing within 30 calendar days of the decision that is being appealed. The person reviewing the appeal will meet with each of the management core faculty and the person whose decision is being appealed. Appeals will be decided within 30 days of receipt of the written appeal. Decisions of the Dean are appealed to the Provost and decisions of the Provost are appealed to the President. Appeal decisions by each of the Provost and the President are final.
Notwithstanding the foregoing,
- The terms of a faculty member’s initial appointment at the University cannot be appealed.
- With respect to the Contracts and Promotion Policy, only final decisions by the Provost denying reappointment can be appealed, and
- appeals of non-reappointment decisions due to performance considerations are limited to allegations of whether the University’s decision was made in an arbitrary or capricious manner; and
- decisions of non-reappointment for other reasons cannot be appealed.
- In the event of contract termination or modification, the University’s determinations about extraordinary changes, institutional financial exigency, significant program reduction, or program closure cannot be appealed.
- Decisions made by the President cannot be appealed.
- Appeals alleging discrimination or harassment must be brought pursuant to the Discrimination, Harassment, and Sexual Violence Policy and the related Complaint Resolution Procedure, not pursuant to this Appeals Process.
Pursuant to the May 18, 2017 vote of the Board of Trustees, the Provost hereby adopts this Appeals Process. The President or the Provost shall review and may revise this Appeals Process from time to time.
